These Terms and Conditions of Service govern your access to and use of the mobile application Instacast, developed and distributed by Matteo Venturi. By downloading, installing, or using the App, you agree to be bound by these terms.

1. Purpose of the Application and License Grant

Instacast is a software application for Android devices designed to enable users to stream audio and organize publicly accessible video content or content saved in their personal Instagram account into podcasts, featuring a specialized user interface optimized for in-vehicle systems (Android Auto).

The Developer grants you a personal, revocable, non-exclusive, and non-transferable license to use the Application for personal, non-commercial purposes.

2. Non-Affiliation Disclaimer

Instacast is an independent software project.
The App is not affiliated with, sponsored, endorsed, authorized, or officially connected with Instagram, Meta Platforms, Inc., or any of their subsidiaries or affiliates. The name "Instagram", associated trademarks, logos, and brand assets are registered trademarks of Meta Platforms, Inc. or their respective owners.

3. Intellectual Property and Copyright Compliance

You acknowledge and agree that all multimedia content (audio, video, text, trademarks) accessed through the Application remains the exclusive property of their respective creators and copyright holders. The App functions solely as a media player for personal and private use: users are responsible for complying with applicable copyright laws and the terms of service of the third-party platforms from which content originates.

4. Driving Safety and Driver Responsibility

Although Instacast is specifically designed to minimize driver distractions through Android Auto integration and steering wheel controls:

• Road safety is always the highest priority. You bear full and sole responsibility for operating your vehicle safely and in compliance with all applicable traffic laws and motor vehicle regulations.
• Never interact manually with your smartphone screen or the vehicle's display if doing so diverts your attention from driving conditions or the road ahead.
• The Developer shall not under any circumstances be held responsible or liable for traffic violations, accidents, damages, or injuries resulting from improper, negligent, or distracted use of the Application while driving.

5. Disclaimer of Warranties and Limitation of Liability

The Application is provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, either express or implied. The Developer does not warrant that the service will be uninterrupted, error-free, or perpetually accessible, particularly in consideration of potential technical changes, access restrictions, or updates to third-party APIs and platforms (such as Instagram).

6. Changes to Terms

We reserve the right to revise or update these Terms at any time. Your continued use of the App following the posting of updated terms will constitute your acceptance of such changes.

7. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Italy.
